By creating an account or using nudge.reviews, you agree to these Terms and Conditions.

1. Agreement

These Terms govern your use of Nudge, a software service for sending review-request text messages and managing related message history, clicks, and follow-ups.

2. Eligibility

You must be at least 18 years old and authorized to bind the business or organization that uses the service.

3. Account Responsibilities

  • You must provide accurate account information and keep login credentials secure.
  • You are responsible for activity that occurs under your account.
  • You must keep your Google review link, business identity, and message template information accurate.

4. Subscription and Billing

Paid subscriptions are billed through Stripe. Fees are billed in advance and renew until canceled. Trial, pricing, and plan details shown in the app may change over time.

5. SMS Messaging Rules

Because Nudge sends SMS messages on your behalf, you agree that:

  • You will send messages only to recipients who gave any consent required by applicable law.
  • You will identify your business accurately in the message content you send through the service.
  • You will not use Nudge for spam, harassment, fraud, or unlawful marketing.
  • You will not attempt to send to people who have opted out, and you will respect suppression or STOP responses recorded by the service.
  • You are responsible for your own compliance with TCPA, state privacy laws, carrier rules, and other applicable laws.

Nudge may block sends to numbers that have opted out or that are rejected by our messaging providers for compliance or deliverability reasons.

6. Acceptable Use

  • Do not upload data you do not have the right to use.
  • Do not reverse engineer, disrupt, or misuse the service.
  • Do not transmit unlawful, abusive, deceptive, or infringing content.
  • Do not use the service in a way that could harm our platform, providers, or other users.

7. Third-Party Services

The service depends on providers such as Twilio, Stripe, Supabase, and Vercel. Availability and delivery may be affected by those providers, and we are not responsible for outages or policy decisions made by them.

8. Data and Privacy

Our Privacy Policy explains how we handle account data, customer contact data, cookies, and suppression records.

9. Suspension and Termination

We may suspend or terminate access if we believe your use violates these Terms, provider requirements, or applicable law. You may stop using the service at any time and may request account deletion through the app.

10. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law.

We do not promise any specific business outcome, review volume, delivery rate, or search-ranking improvement.

11. Limitation of Liability

To the maximum extent permitted by law, Nudge will not be liable for indirect, incidental, special, consequential, or punitive damages.

Our aggregate liability for claims related to the service will not exceed the fees you paid us in the three months before the claim arose.

12. Indemnity

You will defend and indemnify Nudge against claims arising from your data, your messages, your alleged lack of consent, or your violation of these Terms or applicable law.

13. Governing Law and Venue

These Terms are intended for a US launch. Before public launch, you should update this section with the governing law, venue, and legal entity details that apply to your business.

14. Changes

We may update these Terms from time to time. Material changes may be posted in the product or sent by email.
